SharePoint 2007 to SharePoint 2013 Upgrade

Hi,

Based on my understanding of the Migration path, SharePoint 2007 needs to be first migrated to 2010 and then upgraded to SharePoint 2013. Many of the blogs recommend the approach of using SharePoint 2010 120-Day trial version for performing the upgrade - is this a legal procedure?

Is it necessary to obtain a SharePoint 2010 license for migration to 2013?
